Court of Appeal Hears Nalukoola’s Appeal Against Nullified Kawempe North By-election Victory

Although the High Court nullified Nalukoola’s election to the 11th Parliament, the parliamentary term has since ended. Nalukoola contested again in the 2026 General Election and was elected once more as the Member of Parliament for Kawempe North.

The Court of Appeal has commenced hearing an election appeal filed by Kawempe North Member of Parliament Elias Luyimbazi Nalukoola, who sought court redress seeking to overturn a High Court decision that nullified his victory in the 2025 Kawempe North parliamentary by-election.

The appeal, Luyimbazi Elias Nalukoola v. Nambi Faridah, is among 34 civil matters scheduled for hearing during the Court of Appeal’s three-day Civil Appeals Session, which began on Monday in Kampala.

Nalukoola is challenging the High Court ruling that set aside his election as the Kawempe North MP. Both the appellant and his legal team were present in court as the hearing got underway.

The case is being heard by a panel of three justices comprising Lady Justice Irene Mulyagonja, Justice Mike Musisi and Lady Justice Esta Nambayo.

According to the cause list signed by the Deputy Registrar of the Court of Appeal, Janeva H.W. Natukunda, the session will handle a wide range of civil matters, including land disputes, breach of contract cases, divorce petitions, compensation claims, defamation suits, taxation matters, unlawful publication cases and other civil appeals.

The Civil Appeals Session is scheduled to run from Monday, July 27, to Thursday, July 30, 2026. However, cases that had initially been listed for Tuesday have been rescheduled to Friday, July 31, due to the public holiday.

The Court of Appeal said the special session is part of its ongoing efforts to expedite the disposal of pending cases, reduce the case backlog and improve access to justice.

Although the High Court nullified Nalukoola’s election to the 11th Parliament, the parliamentary term has since ended. Nalukoola contested again in the 2026 General Election and was elected once more as the Member of Parliament for Kawempe North.

The outcome of the appeal is expected to clarify legal issues arising from the nullified 2025 by-election, despite Nalukoola having since secured a fresh mandate from the electorate.
