State prosecutors have confirmed that lawyer Angela Mulwa will face a murder charge in the High Court over the killing of Dr. Victoria Nthunya Mutiso.

State Prosecutor Jalson Makori informed Milimani Law Court Magistrate Joan Maru of the development during a miscellaneous court proceeding that opened on August 21, following Mulwa’s arrest on August 20. Mulwa spent the weekend in custody at the Industrial Area Police Station while detectives pursued further leads.

When defense counsel asked prosecutors to disclose a timeline for plea-taking, Makori stated he could not provide a specific date because the High Court had not yet scheduled the session. Consequently, the prosecution requested the magistrate to close the miscellaneous file, noting the matter had become moot after the murder charge moved to the High Court.

According to an affidavit sworn by Corporal Romana Odour of the Homicide Investigations Bureau, police requested additional time to finalize investigations into the July 29 killing of Dr. Mutiso, who was shot while inside motor vehicle KDJ 609D in Upper Hill, Nairobi.

Detectives recovered two spent cartridges and two bullet fragments at the crime scene and submitted them for forensic analysis. Investigators also retrieved CCTV footage, obtained call data records, and impounded motorcycle KMGZ 980D alongside vehicles KDJ 609D, KDH 600A, and KDE 400W for forensic examination.

The Directorate of Criminal Investigations (DCI) is pursuing several potential motives, including an active land dispute involving parcel L.R. No. 1504/13 in Machakos. Police noted that Dr. Mutiso had previously reported being stalked and survived an earlier attempted attack, which she reported at Kilimani Police Station under OB No. 63/07/07/2026.

Preliminary findings by the DCI place Mulwa – identified in court filings as the deceased’s stepdaughter – among the key suspects. Police allege Mulwa attended a demolition and eviction at the disputed property and was linked to individuals involved in the land dispute.

The DCI further alleges that Mulwa was present on April 24, 2026, when a Ksh300,000 down payment was made to facilitate the initial, failed murder attempt against Dr. Mutiso.

Investigators also allege that Mulwa maintained continuous communication with Senior Police Officer Kenneth Sang, whose firearm (s/no 47302127) was allegedly used in the commission of the crime.

Detectives opposed Mulwa’s release, citing risks of witness interference, collusive story matching with co-suspects, and potential destruction of documentary and electronic evidence. The intelligence-led investigation remains active as authorities pursue additional suspects, including other senior police officers and individuals identified as Rose Mbithe Mulwa (alias Rose Mbithe Ndelei), Chris Mulwa, Elijah Kibelion Kimoi, Daniel Mwangi Njoroge, and Kelvin Ngugi Kinuthia.

With prosecutors having lodged the formal indictment in the High Court, Mulwa will take her plea once the court issues its official schedule.
