Walukaaga Still in MP Race, EC Has No Power Over His Papers – Counsel Nalukoola
Counsel Elias Luyimbazi Nalukoola has come out to defend Mathias Walukaaga, insisting the singer is still legally in the Busiro East parliamentary race despite his disqualification by the Electoral Commission.
Speaking to a local YouTuber, Nalukoola argued that the Electoral Commission has no authority to scrutinize or determine the authenticity of Walukaaga’s academic papers.
According to the lawyer, that mandate belongs solely to the National Council for Higher Education (NCHE), and the Electoral Commission can only act based on what NCHE confirms.
“The Electoral Commission has no power to determine Walukaaga’s academic qualifications. Those powers are for the National Council for Higher Education. His documents were certified by NCHE, and that is what EC should rely on,†Nalukoola stated.
He revealed that the legal team has already begun the process of filing an appeal in the High Court of Uganda, challenging Justice Simon Byabakama’s decision.
“We are going to the High Court to appeal the Commission’s ruling. Walukaaga remains in the race until the appeal is determined,†he added.
On Tuesday morning, Walukaaga was thrown out of the Busiro East MP contest over claims that his Mature Age Entry certificate had expired by the time of nomination.
