Kabale High Court Acquits Six in Kisoro Murder and Aggravated Robbery Case

Six residents of Nyakarembe Village, Kagunga Parish in Bukimbiri Sub-County, Bukimbiri County, have been released from Kisoro Government Prison following a High Court ruling that acquitted them of murder and aggravated robbery charges.

The suspects, Ezra Monday, Tomas Arinaitwe, Gerald Bajenyi, Agaba Valentine, Enock Mugabe, and Junior Nasasira, had been accused of killing 56-year-old teacher Sunday Callist at Kayihumure Primary School on February 17, 2024. They were detained shortly after the incident.

On Tuesday, a High Court sitting led by Kabale High Court Resident Judge Justice Karoli Lwanga Ssemogerere ordered their release at Kisoro Chief Magistrates Court.

During the hearing, the prosecution, led by State Attorney Christopher Ainomugisha, presented witness testimonies against all the accused. However, the defense, led by Counsel Rodgers Nabaasa, argued that the prosecution had failed to establish a credible case. The court agreed, ruling that there was insufficient evidence to put the accused on trial.

The six were acquitted on the basis of “no case to answer.” The ruling highlights significant flaws in the prosecution’s case and opens the possibility for the acquitted individuals to pursue compensation for malicious prosecution, including damages for the time spent in detention.

Speaking after the ruling, Agaba Valentine said: “We have suffered a lot, but by God’s mercy, justice has prevailed. I plan to seek compensation for the losses suffered during my time in prison.”
